Counselera Inc. (“Counselera”, “we”, “us”, or “our”), a Georgia corporation, provides practice management software for law firms and legal professionals (the “Service”). This Privacy Policy explains what information we collect, how we use and share it, and the choices you have. By using the Service or our website at counselera.com, you agree to the practices described here.
1. Who we are
Counselera Inc. is the entity responsible for the Service. Our mailing address is 5201 Brook Hollow Pkwy STE C, Norcross, GA 30071, Georgia, USA. For any privacy question, you can reach us at privacy@counselera.com.
2. Scope of this policy
This policy applies to information we collect through our website, our applications, and the Service. It does not apply to the internal privacy practices of the law firms that use Counselera, or to third party websites and services that we do not control.
A note on roles. Much of the data inside the Service is entered by a law firm about its own clients and matters. For that data, the firm decides what is collected and why, and Counselera acts on the firm’s behalf as a service provider. Section 5 explains this in more detail.
3. Information we collect
Information you provide. When you create an account, subscribe, or contact us, we collect information such as your name, firm name, email address, phone number, job title, mailing address, and login credentials.
Firm and client data. When you use the Service, you and your firm enter information about clients, matters, calendars, deadlines, documents, communications, time entries, invoices, and trust and expense records. This content belongs to your firm and is handled as described in Section 5.
Payment information. When you pay for the Service, our payment processor collects and processes your payment details. We do not store full card numbers on our systems. We receive limited information such as the last four digits, card type, and billing status.
Information collected automatically. When you use the Service, we automatically collect usage and device information, including IP address, browser and device type, operating system, pages and features used, access times, and log data. We collect this through cookies and similar technologies described in Section 8.
Information from third parties. We may receive information from service providers that help us operate, secure, and improve the Service, and from integrations you choose to connect.
4. How we use information
We use the information we collect to provide, maintain, secure, and improve the Service, to create and manage accounts, to process payments and subscriptions, to provide support, to communicate with you about the Service, to detect and prevent fraud and abuse, to develop new features, and to comply with legal obligations. We use aggregated or deidentified information, which does not identify any individual, for analytics and product development.
We do not sell your personal information, and we do not use the private content your firm stores in the Service to advertise to you.
5. Firm data and your role
For information a firm enters about its own clients and matters (“Firm Data”), the firm controls the purposes and means of processing, and Counselera processes that data on the firm’s instructions to deliver the Service. The firm is responsible for having the appropriate rights and disclosures to place that data in the Service and to authorize our processing of it.
Firm Data remains the property of the firm. We access it only as needed to operate, secure, support, and improve the Service, to comply with law, or as the firm directs. If you are a client of a firm that uses Counselera and you want to exercise rights over your data, please contact that firm directly, and we will support the firm in responding.
6. How we share information
We share information only as described here.
Service providers. We share information with vendors who perform services for us, such as cloud hosting, payment processing, email delivery, analytics, and customer support. These providers may access information only to perform services for us and are bound by confidentiality and data protection obligations.
Integrations you choose. If you connect a third party service, we share information with that service as needed to make the integration work, at your direction.
Legal and safety. We may disclose information if required by law, subpoena, or legal process, or when we believe disclosure is necessary to protect our rights, the safety of any person, the integrity of the Service, or to investigate fraud or abuse.
Business transfers. If Counselera is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction. We will notify you of any change in ownership or use of your information.
We do not sell personal information to third parties.
7. Cookies and similar technologies
We use cookies and similar technologies to keep you signed in, remember your preferences, understand how the Service is used, and improve performance. You can control cookies through your browser settings. Some features may not function properly if certain cookies are disabled. Where required by law, we ask for consent to nonessential cookies.
8. Data security
We maintain administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, and destruction. These include encryption of data in transit and at rest, access controls, monitoring, and regular review of our practices. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your login credentials confidential.
9. Data retention
We retain information for as long as your account is active and as needed to provide the Service, and afterward as required to comply with legal obligations, resolve disputes, and enforce our agreements. Firm Data is retained according to the firm’s subscription and instructions. On termination, we make Firm Data available for export for a limited period and then delete or deidentify it in the ordinary course, unless retention is required by law.
10. Your privacy rights
Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, and to object to or restrict certain processing. To exercise these rights, contact us at privacy@counselera.com. We will verify your request and respond within the time required by applicable law. We will not discriminate against you for exercising your rights.
California residents. If you are a California resident, you may have rights under the California Consumer Privacy Act as amended, including the right to know what personal information we collect, use, and disclose, the right to request deletion, the right to correct inaccurate information, and the right to opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined by California law. To make a request, contact privacy@counselera.com.
Other state residents. If you live in a state with a comprehensive privacy law, you may have similar rights. Contact us at privacy@counselera.com and we will honor the rights available to you.
Marketing choices. You can opt out of marketing emails at any time using the unsubscribe link in the message. We may still send you service and account related messages.
11. International users and data transfers
The Service is operated from the United States. If you access the Service from outside the United States, you understand that your information will be processed in the United States, where privacy laws may differ from those in your location. Where required, we put appropriate safeguards in place for international transfers.
12. Children’s privacy
The Service is intended for use by legal professionals and is not directed to children. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected such information, we will delete it.
13. Third party links and services
The Service and our website may link to third party sites and services that we do not control. This policy does not apply to those third parties, and we are not responsible for their practices. We encourage you to review their privacy policies.
14. Changes to this policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the effective date and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised policy.
